Chapter 7 Bankruptcy Overview
When you have debts such as credit card, medical, personal guarantees, signature loans, most money judgments and many taxes, a Chapter 7 bankruptcy may be perfect for you.
Most of my clients in Chapter 7 keep all their household possessions, home, cars, retirement funds and other assets. It is possible that your Chapter 7 case wipes out certain IRS taxes; removes most judgment liens that may be harming the title to your home, and force a bank to mediate your home loan.
Allows you to stay in business while reorganizing the debts in a manageable payment plan all under the bankruptcy court’s protection.
Reorganize Your Debts
I typically file Chapter 11 Bankruptcy for businesses or individuals that need to reorganize to get some breathing room from their debts, obligations, contracts, leases, tax problems and landlords.
You still keep control of your business. A Chapter 11 Plan can keep your business “in business” and survive. It can pay back taxes over many years, even IRS 941 and sales taxes. Your reorganization eventually will pay the creditors some of their money but usually a fraction of what is owed at an amount your business can afford.
Allows individuals to shelter their property, stop foreclosures, save their home or car, reduce their debt, while protected by the court.

A Chapter 13 Bankruptcy acts like a great interest free debt consolidation where I ensure you get to keep your assets and pay some or all of your debt over the course of up to five years.
